SIArb Masterclass Series: Drafting Winning Interest Submissions

Introduction

This masterclass will focus on an often underappreciated, but critical part of international arbitration – interest on amounts awarded. It will treat the subject from two perspectives – crafting persuasive and effective interest submissions, and deciding on those submissions (correctly!).

The masterclass will be given by Jonathan Ellis of HKA in Singapore, a leading damages expert and Dr Matthew Secomb, a partner at White & Case in Singapore (author of Interest in International Arbitration (2019, OUP)).

Among other things, the masterclass will consider:

• The law applicable to interest, and the conflicts of law issues that attach to it
• Various laws’ approach to interest (common law, civil law, shari’a law)
• The economics of interest, and the economic arguments that can be used on interest
• The elements of interest (rate, dates and calculation method)
• Interest as an element of damages
