HKA will be holding this final breakfast event in the series for 2023. Join us in-person with the panel discussing the topic of Extensions of Time in Adjudication and the issues to be considered by the Referring and Responding Parties, including:

  • Practical proactive considerations before the commencement of an adjudication
  • Adjudication tactics:
    • Submissions – choice of delay analysis methodology, evidential support for the claim/defence presented and complexity and proportionality.
    • Timetable
    • Serial adjudications
  • Typical challenges faced:
    • Presenting a clear and robust case that will appeal to an adjudicator
    • Independence of experts (hired guns)  
    • Overlay of any claim for loss & expense.

MODERATOR:

Andrew White, Partner and Delay Expert – HKA

Andrew is a Chartered Construction Manager with 24 years of experience in construction project management and 16 years in forensic delay analysis. He is regularly appointed as an Expert and Expert Advisor on delay and construction project management matters in adjudication, arbitration and litigation.

Andrew also provides assessments and audits of extension of time entitlement, preparation and defence of claims, programme feasibility, project monitoring, time controls and associated construction management matters and is highly proficient in both retrospective and prospective delay analysis methodologies, factual analysis and identification of issues, use of planning software and developing and presenting clear, concise and robust conclusions.

SPEAKERS:

Mark Dixon, Partner/Quantum & Delay Expert/Adjudicator – HKA

Mark is a dual-qualified Chartered Quantity Surveyor and Chartered Arbitrator with over 35 years of experience in construction and engineering.

He has been appointed as adjudicator or arbitrator on over 500 cases since 2002. Mark holds the CIArb’s Arbitration and Adjudication Panel Practice Certificates and is on adjudication registers of the RICS, ICE, CIArb, TeCSA, RIBA, CIC, and www.constructionadjudicators.com, and arbitration registers of the RICS, CIArb, ICC, LCIA, HKIAC, AIAC, CIETAC, SHIAC, SCIA, and PIAC.

Mark is also a very experienced expert witness who has acted on numerous large international cases with disputed sums up to US$1.2 billion. He has given oral testimony (cross-examination and concurrent expert conferencing) in the English Courts—including the TCC—and in international arbitration proceedings, having first testified in Court as an expert witness in 1995

Karen Best, Partner and Delay Expert – HKA

Karen is a Chartered Civil Engineer with nearly 30 years of experience in the construction and engineering industries. She worked as a site agent and senior engineer for almost a decade before moving into construction consultancy, giving her a strong grounding for the delay expert and expert assistant roles that she has undertaken.

Karen has been appointed as delay expert on more than 15 occasions regarding building and power related project disputes. She has also assisted the named expert on 15 occasions on various projects across the Middle East, Europe and the Americas. Karen has been cross-examined in arbitration and has a wide range of expert witness training from various institutions including the Academy of Experts, Bond Solon, the Expert Witness Institute and Pearson Education.

Karen is experienced in construction management, project planning and critical path methods of retrospective delay analysis. She has worked on expert appointments related to delay and disruption claims regarding civil engineering and building contracts from power plants in Qatar and industrial facilities in Australia to numerous buildings and infrastructure projects across Europe, the UK and Africa.

Jessica Neuberger, Partner (Construction & Engineering) – Eversheds Sutherland

Jessica specialises in all forms of construction, engineering and operation disputes arising in the built environment, resources and infrastructure sectors and has experience of all forms of dispute resolution including adjudication, litigation, arbitration, expert determination and mediation.

She has particular expertise in complex PFI/PPP disputes across multiple sectors (waste, health, education, accommodation, transport and defence) acting for public sector clients, sponsors, equity investors, debt financiers, construction contractors and operators.

Jessica is ranked as a Next Generation Lawyer in Legal 500 and is a member of the Society of Construction Law, the Adjudication Society and Women in Law London.

Jonathan Lewis KC, Barrister – 4 Pump Court

Jonathan is recommended as a leading Construction barrister in Chambers & Partners, Chambers Global and the Legal 500.

He specialises principally in construction and engineering disputes in litigation, arbitration and adjudication and he also has considerable experience in professional negligence work involving construction professionals.
