Progress and Critical Paths – Then and Now – the Paradox of Contemporaneous Reporting and Retrospective EoT Analysis
Steven Cheema and Oguzhan Cinar (HKA) will discuss the determination of the critical path at various stages of the project, misreporting of progress and its consequences and, differences in EoT Entitlement flowing from different methodologies yielding different critical paths.

Building Safety Act – 1 Year On – What do you need to know?
Sean Garbutt (Gowling WLG) will look at the background to the Act, design, construction and occupation phases, “Higher Risk Buildings” and Liabilities.

SPEAKERS

Steven Cheema, Managing Consultant – HKA

Steven is a Managing Consultant in the HKA UK & Europe delay team and prior to his career in consultancy was an experienced Project Manager with a major UK contractor having successfully managed complex commercial and aviation projects.

Steven has delay analysis experience in water treatment facilities, chemical processing plants and building projects and has recently coauthored an article for Lexis Nexis on “Delay analysis methodologies—practical guidance”.

Oğuzhan Çınar, Senior Consultant – HKA

Oğuzhan is a Senior Consultant in the HKA UK & Europe delay team and prior to his career in consultancy gained significant experience in billion-dollar infrastructure and building projects under FIDIC and bespoke forms of contract in Qatar, Tanzania and Turkey serving as a Project Control and Cost Engineer.

He is skilled in project control and commercial management disciplines including earned value analysis, activity and source-based budgeting, planning, claim and global settlement issues as well as stakeholder and subcontractor management areas. Combining his knowledge in civil engineering with his experience in different projects and countries enables him to analyse the events accurately and to understand their root causes.

Oguzhan completed a Masters in Project Management at Heriott-Watt University in 2021 by submitting his dissertation “Awareness and Acceptance of Machine Learning Technology among Construction Professionals working in Turkish Contractors” and has since written several articles on Machine Learning, Data and Standardisation.

Sean Garbutt, Principal Associate – Gowling WLG

Sean is a Principal Associate in Gowling WLG’s contentious construction team and has considerable experience in construction litigation and dispute resolution, with a particular practice in building and fire safety matters. He has acted for a wide range of parties including national house builders, developers/funders, social and affordable housing providers, main contractors, subcontractors and end user employers.

In his building and fire safety practice, Sean has litigated a number of matters concerning defective design and workmanship of external facades and structure, including to the commencement of trial, and has settled a number of these matters on behalf of claiming parties for multi-million-pound sums. Sean is also currently involved in the highest profile Remediation Contribution Order nationally, with a final hearing listed for November. It is expected that this judgement will be of major significance to the entire industry as to how the Tribunal service will evaluate and operate its new powers under the Building Safety Act.”
